Searching intellectual property (IP) assets, especially patent claims, for defensive and/or offensive purposes requires a high degree of skill and specialization not common among inventors and business professionals. These types of searches likely require guidance and/or detailed infringement analysis based on legacy, current, or new products. However, even the most respected and useful tools for this purpose make searching difficult and the accuracy of searching poor. Thus, a general and widespread need exists for a tool and/or methodology that can translate the common language of an inventor or business professional into a standard claim language in order to simplify searches and improve accuracy and efficacy of search results.

The novel contribution is an electronic thesaurus, eThesaurus (or in another embodiment a hardcopy Thesaurus), which maps common language to IP claim

language (in a preferred embodiment, bidirectionally) and an algorithm for optimally selecting (i.e. recommending) combinations of search terms based on permutations of the 'critical feature' derived from the eThesaurus. Thus, the eThesaurus comprises both an article, a software (SW) program or code which instantiates the common-to-claim language map and the algorithm, and method by which the articles are practiced. The solution is directed toward performing searches (or other specific functions), or may be used more generally such as to translate a patent or a technical paper.

In context, the novel eThesaurus addresses: • Bi-directional translation, from common to patent claim language AND/OR from patent claim to common language • Common language (e.g., structure/physical/materials/attachments, functions/operations/communications/process/performance) vs. claim language (nouns, verbs, adjectives, adverbs to define structure/function/advantages)

• Ranking of search terms based on term combination logic (i.e. programmable hierarchy priority); for example, a user can tune searches based on any one of the following prioritizations (and others not shown; priority is given by listed order):

• Option A- structures, materials, communications [part A and B], operation • Option B- surfaces, regions, attachments, logic, alternate forms
• Option C- materials, structures, surfaces, fixations, communications, functions
